Welcome to HotSauceAI. Please read these Terms of Service carefully before using our website or purchasing a membership.

1. Your Relationship with HotSauceAI

   1. Your use of HotSauceAI’s products, services, and website (referred to collectively as the “Services”) is subject to the terms of a legal agreement between you and HotSauceAI. “HotSauceAI” means HotSauceAI.com, addressable at P.O. Box 26093, Santa Ana, CA 92799-6093, United States. This document explains how the agreement is made up and sets out the terms of that agreement.
   2. Unless otherwise agreed in writing, your agreement with HotSauceAI will always include, at a minimum, the terms and conditions set out in this document (“Universal Terms”).
   3. Your agreement will also include the terms of any Legal Notices applicable to the Services (“Additional Terms”). Where Additional Terms apply, they will be accessible within or through your use of that Service.
   4. The Universal Terms together with the Additional Terms form a legally binding agreement between you and HotSauceAI. Please read them carefully. Collectively referred to as the “Terms.”
   5. If there is any contradiction between the Additional Terms and the Universal Terms, the Additional Terms shall take precedence for that Service.

2. Accepting the Terms

   1. In order to use the Services, you must first agree to the Terms. You may not use the Services if you do not accept the Terms.
   2. You can accept the Terms by:
      • (A) clicking to accept or agree to the Terms where this option is made available to you in the user interface; or
      • (B) actually using the Services, in which case you understand and agree that HotSauceAI will treat your use as acceptance of the Terms from that point onwards.
   3. You may not use the Services if (a) you are not of legal age to form a binding contract with HotSauceAI, or (b) you are a person barred from receiving the Services under the laws of the United States or other countries including the country in which you are resident or from which you use the Services.
   4. Before you continue, you should print or save a local copy of these Terms for your records.

3. Language of the Terms

   1. Where HotSauceAI has provided a translation of the English language version of the Terms, that translation is provided for your convenience only. The English language version governs your relationship with HotSauceAI.
   2. If there is any contradiction between the English version and a translation, the English version shall take precedence.

4. Provision of the Services by HotSauceAI

   1. HotSauceAI may work with third-party service providers, technology partners, payment processors, and affiliated tools and platforms (“Service Partners”) to deliver the Services to you. You acknowledge and agree that such Service Partners may be involved in providing portions of the Services on behalf of HotSauceAI. This includes, but is not limited to, payment processing via Stripe, hosting infrastructure, and third-party tools or platforms that HotSauceAI recommends or integrates with. Your use of any third-party service is subject to that party’s own terms and policies.
   2. HotSauceAI is constantly innovating to provide the best possible experience. You acknowledge and agree that the form and nature of the Services may change from time to time without prior notice.
   3. As part of this continuing innovation, you acknowledge and agree that HotSauceAI may stop (permanently or temporarily) providing the Services or any features within the Services at its sole discretion, without prior notice. You may stop using the Services at any time without notifying HotSauceAI.
   4. You acknowledge and agree that if HotSauceAI disables access to your account, you may be prevented from accessing the Services, your account details, or any content within your account.
   5. You acknowledge and agree that HotSauceAI may set limits on usage, storage, or transmissions at any time at its discretion.

5. Memberships, Payments, and Access

   1. HotSauceAI offers membership subscriptions that provide access to digital content including tutorials, videos, prompts, downloadable assets, and other educational materials (collectively “Member Content”). Membership plans, pricing, and included features are described on the site and are subject to change.
   2. All payments are processed securely by Stripe. HotSauceAI does not store your credit card or payment details. By purchasing a membership, you agree to Stripe’s terms of service and privacy policy.
   3. Your membership begins on the date of purchase and remains active through the end of the subscription period. Access to Member Content requires an active, paid membership (indicated by an active subscription status on your account).
   4. Memberships do not automatically renew unless you enable auto-renewal. It is your responsibility to manage your subscription and renewal settings within your account.
   5. When your membership expires or is cancelled, your account remains active but your access to Member Content will be suspended. Resubscribing will begin a new subscription period.
   6. All sales of memberships and digital content are final and non-refundable. Because access to Member Content is granted immediately upon purchase, no refunds will be issued once access has been provided, except where required by applicable law.
   7. EU / EEA Customers — Right of Withdrawal: Under EU consumer law, you normally have a 14-day right to withdraw from a digital content purchase. However, by completing your purchase and receiving immediate access to Member Content, you expressly consent to the immediate performance of the contract and acknowledge that you lose your right of withdrawal upon commencement of the digital content delivery.
   8. Downloaded assets, prompts, and files obtained during an active membership period are yours to keep after your membership ends. You may not, however, access, stream, or download new Member Content after your membership has lapsed. The license granted to downloaded content is personal and non-commercial with respect to redistribution of HotSauceAI materials (see Section 10).

6. Use of the Services by You

   1. In order to access certain Services, you may be required to provide information about yourself as part of the registration process. You agree that any registration information you give to HotSauceAI will always be accurate, correct, and up to date.
   2. You agree to use the Services only for purposes permitted by (a) the Terms and (b) any applicable law, regulation, or generally accepted practices or guidelines in the relevant jurisdictions.
   3. You agree not to access (or attempt to access) any of the Services by any means other than through the interface provided by HotSauceAI, unless specifically permitted in a separate agreement. You specifically agree not to access the Services through any automated means including scripts or web crawlers.
   4. You agree not to engage in any activity that interferes with or disrupts the Services or the servers and networks connected to the Services.
   5. Unless specifically permitted in a separate agreement, you agree not to reproduce, duplicate, copy, sell, trade, or resell the Services or any Member Content for any purpose.
   6. You agree that you are solely responsible for any breach of your obligations under the Terms and for the consequences of any such breach.

7. Your Passwords and Account Security

   1. You are responsible for maintaining the confidentiality of your account password.
   2. You will be solely responsible for all activities that occur under your account.
   3. If you become aware of any unauthorized use of your password or account, you agree to notify HotSauceAI immediately through this website.

8. Privacy and Your Personal Information

   1. For information about HotSauceAI’s data protection practices, please read HotSauceAI’s Privacy Policy. This policy explains how HotSauceAI treats your personal information and protects your privacy when you use the Services.
   2. You agree to the use of your data in accordance with HotSauceAI’s Privacy Policy.
   3. If you are located in the European Union or European Economic Area, your personal data is processed in accordance with the General Data Protection Regulation (GDPR). The legal basis for processing your data includes performance of a contract (your membership), compliance with legal obligations, and where applicable, your consent. Full details are provided in the Privacy Policy.

9. Content in the Services

   1. You understand that all information, materials, and content available through the Services, including tutorials, videos, prompts, downloadable assets, and written content (collectively “Content”), are the property of HotSauceAI or its licensors unless otherwise stated.
   2. Some Content on HotSauceAI may be created with the assistance of artificial intelligence tools. All AI-assisted Content is reviewed, edited, and published by HotSauceAI and is subject to the same terms as all other Content. HotSauceAI makes no warranty that AI-assisted Content is error-free or suitable for any particular purpose.
   3. Content presented through the Services may be protected by intellectual property rights. You may not modify, rent, lease, loan, sell, distribute, or create derivative works based on this Content unless specifically permitted by HotSauceAI in writing or as described in Section 10.
   4. HotSauceAI reserves the right to pre-screen, review, flag, filter, modify, refuse, or remove any Content from the Services at its discretion.
   5. You are solely responsible for any content you create, transmit, or display while using the Services.

10. Proprietary Rights

    1. You acknowledge and agree that HotSauceAI (or its licensors) owns all legal right, title, and interest in and to the Services and all Content, including all intellectual property rights, whether registered or unregistered.
    2. Nothing in the Terms gives you the right to use any of HotSauceAI’s trade names, trademarks, service marks, logos, domain names, or other distinctive brand features without prior written permission.
    3. You may not remove, obscure, or alter any proprietary rights notices (including copyright and trademark notices) affixed to or contained within the Services.
    4. You may not use any trademark, service mark, trade name, or logo of any company or organization in a way that is likely to cause confusion about the owner or authorized user of such marks.

11. License from HotSauceAI

    1. HotSauceAI grants you a personal, non-transferable, non-exclusive license to access and use Member Content during your active membership period for personal, educational, and professional purposes.
    2. You may use prompts, assets, and other downloaded materials to create your own work, including commercially. However, you may not resell, redistribute, sublicense, or repackage HotSauceAI’s original Content or downloaded files as your own product or service.
    3. You may not copy, modify, create derivative works of, reverse engineer, or attempt to extract source code from any software components of the Services.
    4. You may not assign or sublicense your rights to use the Services or any Content to any third party.

12. Content License from You

    1. You retain copyright and any other rights you already hold in any content you submit, post, or display on or through the Services.
    2. By submitting, posting, or displaying content on or through the Services, you grant HotSauceAI a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to reproduce, adapt, modify, translate, publish, publicly perform, publicly display, and distribute that content solely for the purpose of operating, displaying, and promoting the Services.
    3. You confirm and warrant that you have all rights, power, and authority necessary to grant the above license.

13. Software Updates

    1. The software powering the Services may automatically download and install updates from time to time. These updates are designed to improve, enhance, and further develop the Services. You agree to receive such updates as part of your use of the Services.

14. Ending Your Relationship with HotSauceAI

    1. The Terms will continue to apply until terminated by either you or HotSauceAI as set out below.
    2. If you want to terminate your agreement with HotSauceAI, you may do so by (a) notifying HotSauceAI at any time and (b) closing your account. Your notice should be sent in writing to HotSauceAI’s address set out at the beginning of these Terms.
    3. HotSauceAI may at any time terminate its agreement with you if:
       • (A) you have breached any provision of the Terms or have acted in a manner which clearly shows that you do not intend to, or are unable to, comply with the Terms; or
       • (B) HotSauceAI is required to do so by law; or
       • (C) a partner with whom HotSauceAI offered the Services has terminated its relationship with HotSauceAI or ceased to offer the Services; or
       • (D) HotSauceAI is transitioning to no longer providing the Services to users in the country in which you are resident or from which you use the Services; or
       • (E) the provision of the Services to you is, in HotSauceAI’s opinion, no longer commercially viable.
    4. Nothing in this Section shall affect HotSauceAI’s rights regarding provision of Services under Section 4.
    5. When these Terms come to an end, all legal rights, obligations, and liabilities that have accrued shall be unaffected, and the provisions of Section 20.7 shall continue to apply indefinitely.

15. EXCLUSION OF WARRANTIES

    1. NOTHING IN THESE TERMS, INCLUDING SECTIONS 15 AND 16, SHALL EXCLUDE OR LIMIT HotSauceAI’S WARRANTY OR LIABILITY FOR LOSSES WHICH MAY NOT BE LAWFULLY EXCLUDED OR LIMITED BY APPLICABLE LAW. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR CONDITIONS OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR LOSS OR DAMAGE CAUSED BY NEGLIGENCE, BREACH OF CONTRACT OR BREACH OF IMPLIED TERMS, OR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, ONLY THE LIMITATIONS WHICH ARE LAWFUL IN YOUR JURISDICTION WILL APPLY TO YOU AND OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
    2. YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK AND THAT THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
    3. IN PARTICULAR, HotSauceAI AND ITS LICENSORS DO NOT REPRESENT OR WARRANT TO YOU THAT:
       • (A) YOUR USE OF THE SERVICES WILL MEET YOUR REQUIREMENTS,
       • (B) YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR FREE FROM ERROR,
       • (C) ANY INFORMATION OBTAINED THROUGH YOUR USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE, OR
       • (D) DEFECTS IN THE OPERATION OR FUNCTIONALITY OF ANY SOFTWARE PROVIDED AS PART OF THE SERVICES WILL BE CORRECTED.
    4. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH USE OF THE SERVICES IS DONE AT YOUR OWN RISK. YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR DEVICE OR LOSS OF DATA RESULTING FROM SUCH DOWNLOAD.
    5. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM HotSauceAI OR THROUGH THE SERVICES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
    6. HotSauceAI EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

16. LIMITATION OF LIABILITY

    1. SUBJECT TO SECTION 15.1 ABOVE, YOU EXPRESSLY UNDERSTAND AND AGREE THAT HotSauceAI AND ITS LICENSORS SHALL NOT BE LIABLE TO YOU FOR:
       • (A) ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, INCLUDING BUT NOT LIMITED TO ANY LOSS OF PROFIT, LOSS OF GOODWILL OR BUSINESS REPUTATION, LOSS OF DATA, COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, OR OTHER INTANGIBLE LOSS; OR
       • (B) ANY LOSS OR DAMAGE INCURRED BY YOU AS A RESULT OF:
         • (I) ANY CHANGES WHICH HotSauceAI MAY MAKE TO THE SERVICES, OR FOR ANY PERMANENT OR TEMPORARY CESSATION IN THE PROVISION OF THE SERVICES;
         • (II) THE DELETION OF, CORRUPTION OF, OR FAILURE TO STORE ANY CONTENT OR DATA MAINTAINED OR TRANSMITTED THROUGH YOUR USE OF THE SERVICES;
         • (III) YOUR FAILURE TO PROVIDE HotSauceAI WITH ACCURATE ACCOUNT INFORMATION; OR
         • (IV) YOUR FAILURE TO KEEP YOUR PASSWORD OR ACCOUNT DETAILS SECURE AND CONFIDENTIAL.
    2. THE LIMITATIONS ON HotSauceAI’S LIABILITY SHALL APPLY WHETHER OR NOT HotSauceAI HAS BEEN ADVISED OF OR SHOULD HAVE BEEN AWARE OF THE POSSIBILITY OF ANY SUCH LOSSES ARISING.

17. Copyright and Trademark Policies

    1. It is HotSauceAI’s policy to respond to notices of alleged copyright infringement that comply with applicable intellectual property law, including the Digital Millennium Copyright Act (DMCA) in the United States, and to terminate the accounts of repeat infringers.
    2. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please contact HotSauceAI’s designated DMCA agent at: dmca@hotsauceai.com. Your notice must include: (a) identification of the copyrighted work claimed to be infringed; (b) identification of the infringing material and its location on the site; (c) your contact information; (d) a statement of good faith belief that the use is not authorized; and (e) a statement under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

18. Third-Party Links and Resources

    1. The Services may include hyperlinks to other websites, tools, or resources not operated by HotSauceAI. These may include recommended AI tools, platforms, affiliate products, or other third-party services.
    2. You acknowledge and agree that HotSauceAI is not responsible for the availability of any such external sites or resources and does not endorse any advertising, products, or other materials on or available from such sites or resources.
    3. You acknowledge and agree that HotSauceAI is not liable for any loss or damage which may be incurred by you as a result of your use of or reliance on any external sites, resources, or third-party content.
    4. Some links on the Services may be affiliate links, meaning HotSauceAI may earn a commission if you make a purchase through those links, at no additional cost to you.

19. Changes to the Terms

    1. HotSauceAI may make changes to the Universal Terms or Additional Terms from time to time. When changes are made, HotSauceAI will make a new copy of the Universal Terms available on the Services.
    2. You understand and agree that if you use the Services after the date on which the Terms have changed, HotSauceAI will treat your continued use as acceptance of the updated Terms.

20. General Legal Terms

    1. Sometimes when you use the Services, you may use a service, download software, or purchase goods provided by another person or company. Your use of those other services or goods may be subject to separate terms between you and that company or person. The Terms do not affect your legal relationship with those other companies or individuals.
    2. The Terms constitute the whole legal agreement between you and HotSauceAI and govern your use of the Services, completely replacing any prior agreements between you and HotSauceAI in relation to the Services.
    3. You agree that HotSauceAI may provide you with notices, including those regarding changes to the Terms, by email, regular mail, or postings on the Services.
    4. You agree that if HotSauceAI does not exercise or enforce any legal right or remedy contained in the Terms, this will not be taken as a formal waiver of HotSauceAI’s rights, and those rights or remedies will still be available to HotSauceAI.
    5. If any court of law, having jurisdiction to decide on this matter, rules that any provision of these Terms is invalid, then that provision will be removed without affecting the rest of the Terms. The remaining provisions will continue to be valid and enforceable.
    6. These Terms, and your relationship with HotSauceAI under the Terms, shall be governed by the laws of the State of California without regard to its conflict of laws provisions. You and HotSauceAI agree to submit to the exclusive jurisdiction of the courts located within the State of California to resolve any legal matter arising from the Terms. Notwithstanding this, HotSauceAI shall still be allowed to apply for injunctive remedies in any jurisdiction. Consumers in the European Union or European Economic Area are not deprived of the protection afforded to them by the mandatory provisions of the consumer protection laws of their country of residence.
    7. You and HotSauceAI agree that the Terms, and your relationship with HotSauceAI, do not create a joint venture, partnership, employment, or agency relationship between you and HotSauceAI.
